By accessing or using this website (the Website) or by placing an order with us, you agree to be bound by these Terms and Conditions (Terms). If you do not agree, please do not use the Website or purchase our products.

1. About Us

LM Hair Health Pty Ltd (ABN 38 689 232 657) is an Australian company registered in Western Australia. At present, we sell an oral hair health supplement (Product). We intend to expand our range in the future to include topical hair treatments and accessories such as hair bonnets, towels, and combs (together with the supplement, the Products).

2. Acceptance of Terms

These Terms apply to your use of the Website and to all orders you place with us. By browsing the Website or placing an order, you confirm that:

(a) you are at least 18 years of age;

(b) you have read and understood these Terms; and

(c) you agree to be bound by these Terms and any additional policies referred to in them, including our Privacy Policy and Returns Policy.

We reserve the right to amend these Terms at any time by posting the updated version on the Website. Your continued use of the Website after any amendment constitutes acceptance of the amended Terms.

3. Products and Product Descriptions

3.1 We take reasonable care to ensure that all descriptions, images, and prices of Products displayed on the Website are accurate at the time of publication. However, we do not warrant that Product descriptions, images, or other Website content are error-free, complete, or current. We reserve the right to correct errors or update information at any time without prior notice.

3.2 Products are subject to availability. We reserve the right to limit quantities and to discontinue any Product without notice.

3.3 Colours and appearances of Products as depicted on the Website may vary from the actual Product due to factors including monitor display settings and packaging changes.

4. Product Disclaimers and Health Information

4.1 Our oral supplement is included on the Australian Register of Therapeutic Goods (ARTG) under listing/registration number AUST [L] 524287 and is regulated as a therapeutic good under the Therapeutic Goods Act 1989 (Cth). Any topical hair treatments or accessories we offer in the future are, or will be, cosmetic or general wellness products only and will not be listed or registered on the ARTG unless we state otherwise.

4.2 Any information on this Website about our oral supplement is limited to the indications approved for that Product's listing or registration on the ARTG. Nothing on this Website constitutes medical advice, diagnosis, or treatment, and no statement should be read as a claim to treat, cure, prevent, or alleviate any disease, condition, or ailment beyond those approved indications, including in relation to hair loss or thinning. Any information provided is for general informational and educational purposes only.

4.3 You should always consult a qualified medical practitioner or healthcare professional before commencing use of any supplement, particularly if you:

(a) are pregnant, breastfeeding, or undergoing assisted reproductive treatment;

(b) are taking prescription or over-the-counter medications;

(d) have any concerns about your health.

4.4 If you experience any adverse effects after using a Product, discontinue use immediately and seek medical advice.

4.5 Our Products are intended for use by adults. Keep all Products out of reach of children.

5. Ordering and Contract Formation

5.1 When you place an order through our Website, you are making an offer to purchase the selected Products at the prices listed. No contract is formed until we accept your order.

5.2 We will send you an order confirmation email upon receipt of your order. This email is an acknowledgement of receipt only and does not constitute acceptance of your order.

5.3 We accept your order (and a binding contract is formed) when we dispatch the Products and send you a dispatch confirmation email. We reserve the right to refuse or cancel any order at our discretion, including where:

(a) a Product is out of stock or has been discontinued;

(b) there is an error in the price or description of a Product; or

5.4 We reserve the right to cancel orders where we reasonably believe they are being placed for commercial resale purposes or in breach of any applicable law.

6. Pricing and Payment

6.1 All prices are in Australian dollars (AUD) and include Goods and Services Tax (GST) unless otherwise stated. Delivery charges are additional and are displayed at checkout.

6.2 We reserve the right to change prices at any time without prior notice. Prices applicable to your order are those displayed at the time you place your order.

6.3 We accept payment by the methods listed on the Website. Payment is processed at the time of order. By providing your payment details, you confirm that you are authorised to use the nominated payment method.

6.4 If your payment is declined or cannot be processed, your order will not be fulfilled.

7. Delivery

7.1 We deliver to addresses within Australia. Delivery to international addresses is not currently available unless expressly stated on the Website.

7.2 We aim to dispatch orders within 2-3 business days of order acceptance, subject to stock availability. Delivery timeframes are estimates only and we do not guarantee delivery by a particular date.

7.3 Risk in the Products passes to you upon delivery to the address you provide. You are responsible for ensuring that an accurate and complete delivery address is provided at checkout. We are not responsible for non-delivery caused by an incorrect or incomplete address.

7.4 If delivery is attempted and no one is available to receive the delivery, the Products may be left in a safe place or a collection card may be left by the carrier. We are not responsible for loss or theft of Products left at an unattended address.

8. Subscription Scheme

8.1 Overview

We offer the following Subscription options (each a Subscription), which will be made available to you as our Product range expands:

(a) Auto-Refill Subscription: you select specific Products, and we automatically dispatch and charge for those Products on your chosen billing frequency (monthly unless you select otherwise); and

(b) Curated Box Subscription: we curate a selection of Products for you each month, which is dispatched and charged on a monthly basis. This option will be introduced once our Product range expands beyond our initial oral supplement and will be clearly indicated as available on the Website.

You may select one or both Subscription types. Each Subscription type is subject to a separate billing cycle and cancellation right.

8.2 Billing — Auto-Renewal

Unless you have elected the confirmed-order option set out in clause 8.3, your Subscription will auto-renew and you will be charged automatically on each billing date using the payment method on file. By signing up to an auto-renewing Subscription, you authorise us to charge your nominated payment method on a recurring basis at the applicable Subscription price until you cancel.

We will send you a reminder email at least 5 days before each auto-renewal charge, which will include the amount to be charged and the date on which payment will be taken. If you do not wish to continue, you must cancel before the date specified in that reminder email.

8.3 Billing — Confirmed Orders

If you elect the confirmed-order option when setting up your Subscription, we will send you a preview email before each billing date setting out the Products proposed for dispatch and the amount to be charged. You will have 5 days from the date of that preview email to:

(a) confirm the order (in which case we will process payment and dispatch);

(b) modify your order (subject to availability); or

If you do not respond within the specified period, the order will be treated as confirmed and payment will be processed automatically.

8.4 Subscription Pricing and Discounts

Subscribers receive a discount of 10% off the standard retail price of Products included in their Subscription. Discounts apply to the Products as configured at the time of each billing cycle. We reserve the right to change Subscription pricing by giving you at least 5 days' prior written notice. If you do not accept a price change, you may cancel your Subscription before the new price takes effect.

8.5 Modifications to Your Subscription

You may modify your Subscription (including changing selected Products, billing frequency, or delivery address) at any time through your account dashboard. Modifications made after the billing date for a given cycle will take effect from the following billing cycle.

8.6 Pausing Your Subscription

You may pause your Subscription for up to 3 consecutive months by notifying us through your account dashboard or by contacting us at hi@foliehairtherapy.com. During a pause, no charges will be processed and no Products will be dispatched. Your Subscription will resume automatically at the end of the pause period unless you cancel it.

8.7 Cancellation

You may cancel your Subscription at any time through your account dashboard or by contacting us at hi@foliehairtherapy.com To avoid being charged for the next billing cycle, you must cancel at least 3 days before your next billing date. Cancellation after your billing date for a given cycle will take effect from the following cycle; you will receive and be charged for the current cycle's order.

We reserve the right to cancel or suspend your Subscription at any time if:

(a) your payment cannot be processed after 3 attempts;

(b) a Product included in your Subscription is discontinued or becomes unavailable; or

If we cancel your Subscription for any reason other than your default, we will give you reasonable prior notice and issue a pro-rata refund for any pre-paid period.

8.8 Subscription Returns

Returns of Subscription Products are subject to our Returns Policy. As Subscription Products are dispatched automatically, we ask that you review your upcoming order details and cancel or modify in time to avoid receiving Products you do not want. Change-of-mind returns of correctly dispatched Subscription Products may be subject to return postage costs.

8.9 Your ACL Rights

Nothing in this clause 8 limits your rights under the Australian Consumer Law. Please refer to clause 9 and our Returns Policy for your rights in respect of faulty or non-conforming Products.

9. Consumer Guarantees and Your Rights Under Australian Consumer Law

9.1 Our Products come with guarantees that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Products repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.

9.2 Nothing in these Terms limits, excludes, or modifies any consumer guarantee, warranty, condition, right, or remedy that cannot be so limited, excluded, or modified under applicable law, including the ACL.

9.3 Please refer to our Returns Policy for full details of how to exercise your rights in respect of faulty, damaged, or non-conforming Products.

10. Intellectual Property

10.1 All content on this Website, including text, images, graphics, logos, product names, and software, is owned by or licensed to us and is protected by Australian and international copyright, trade mark, and other intellectual property laws.

10.2 You must not reproduce, copy, distribute, republish, upload, post, or transmit any content from this Website without our prior written consent, except that you may print or download content for your own personal, non-commercial use.

10.3 Nothing in these Terms grants you any right, title, or licence to use our trade marks, logos, or brand names.

11. Website Use

11.1 You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of any third party.

11.2 You must not use the Website to:

(a) transmit any unsolicited or unauthorised advertising or promotional material;

(b) transmit any data or material that contains viruses or any other harmful programs;

(d) attempt to gain unauthorised access to the Website or any systems connected to it.

11.3 We reserve the right to suspend or terminate your access to the Website at any time and without notice if we reasonably believe you are in breach of these Terms.

12. Third Party Links

The Website may contain links to third-party websites. We do not control, endorse, or accept responsibility for the content or practices of any third-party website. Links are provided for convenience only, and your use of any third-party website is at your own risk. This clause does not affect our own obligations under the Therapeutic Goods Act 1989 (Cth) and the Therapeutic Goods Advertising Code in respect of advertising or representations about our Products that we make, authorise, or for which we are otherwise responsible, including on affiliate, influencer, or partner websites.

13. Limitation of Liability

13.1 To the maximum extent permitted by the ACL and other applicable law:

(a) we exclude all liability for any indirect, incidental, special, consequential, or punitive losses or damages arising from or in connection with your use of this Website or the purchase or use of our Products, including loss of profits, loss of data, personal injury (other than as a result of our negligence), or property damage; and

(b) our total aggregate liability to you in connection with any order or these Terms is limited to the amount paid by you for the relevant order.

13.2 We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any matter for which it would be unlawful to limit or exclude our liability.

13.3 We do not warrant that the Website will be available at all times or free from errors or viruses. We are not liable for any loss arising from your inability to access or use the Website.

14. Privacy and Personal Information

We collect and handle your personal information, including health information, in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Please read our Privacy Policy carefully. By using the Website or purchasing Products, you acknowledge that you have read and understood our Privacy Policy.

15. Governing Law and Jurisdiction

15.1 These Terms are governed by and construed in accordance with the laws of Western Australia and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of the courts of Western Australia and any courts competent to hear appeals from those courts.

15.2 If a dispute arises between you and us, we encourage you to contact us in the first instance to seek an amicable resolution. Nothing in this clause prevents either party from seeking urgent interlocutory or injunctive relief from a court of competent jurisdiction.

16. Severability

If any provision of these Terms is held to be invalid, unenforceable, or illegal, that provision will be severed and the remaining provisions will continue in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Returns Policy, constitute the entire agreement between you and us with respect to your use of the Website and purchase of Products.

18. Waiver

A failure or delay by us to exercise any right or remedy under these Terms does not operate as a waiver of that right or remedy.
